Avesso and its affiliates respect the privacy of their clients, suppliers, and users of their websites. This Privacy Policy describes who we are, what personal data we collect, how we collect that data, for what purposes we may use your data, how we treat it, with whom we share it, how long we retain it, as well as ways to contact us and exercise your rights.

Who we are

Your personal data will be processed by Avesso, corporate entity number 502429518, and its affiliates, hereinafter referred to as the 'Company.' The Company is responsible for the processing of personal data within the meaning of the General Data Protection Regulation.

What data do we collect?

The Company handles, among others, personal data for the following categories:
Identification and contact data (name, address, e-mail address, phone numbers)
Banking and billing information.

How do we collect your personal data?

The Company collects your personal data directly through the Client, namely:

  • When you register online on our page;

  • When you contact us directly, for some motive, through our site via the Internet, through our phone line, or via e-mail;
  • When you subscribe to our Newsletter;
  • When you share your opinion with us;

Why do we need your data?

The Company will use your personal data for the following purposes:

Client management and potential Clients

The handling of your personal data (name, address, phone, e-mail) is mandatory for the execution of the contract to be celebrated between you and the Company, in order to guarantee the shipping of your product.
If you don't provide us your data, we can't provide you the requested delivery service. Your personal data, processed based on the execution of a contract, will be retained for a period of 7 years after your last order.

For the same purpose of managing both customers and potential customers, the customers' personal data may also be processed based on the Company's legitimate interests, notably for litigation management purposes. Personal data processed for this purpose will be preserved for the period necessary to exercise the respective rights.

Marketing

The Company may process your data (e-mail) to send you information about their products and services.

This data processing will only be carried out with your consent, given at the time of subscribing to the newsletter. If you consent, you will receive marketing communications via email. Failure to provide your personal data will prevent the Company from sending you commercial communications. Your data, processed based on your consent, will be retained for this purpose for a period of 7 years after your last order. You may, at any time, object to this data processing by revoking your consent.

Management of complaints and contacts received by the Company

You can send us, via the e-mail specified above, suggestions, opinions, or complaints regarding the services provided by the Company. Your personal data (name and email) will be processed for this purpose based on your consent and on the legitimate interests pursued by the Company, specifically to process and respond to any contact or information request, and to resolve the situation related to your complaint. Your data, processed based on your consent and the legitimate interests of the Company, will be retained for this purpose for the time necessary to resolve your issue.

Supplier management

The personal data of suppliers may be processed by the Company for the purpose of contractual and litigation management. The legal basis is the performance of the Company's contractual obligations and the existence of a legitimate interest on the part of the Company for litigation management purposes. The data will be retained for the period necessary for the fulfillment of contracts and for the exercise of the Company's rights.

Regarding data from the Company's suppliers, it may be provided to the Company's clients for legal or contratual obligations.

Will my data be shared with others?

Your personal information may be disclosed within the corporate group to which Avesso belongs:

To third-party service providers / subcontractors of the Company. Your personal data may be processed by companies subcontracted by the Company, notably for the hosting of the website, email, or email marketing. Only the personal data necessary for the provision of the respective service is provided to these companies. Whenever these third parties process personal data on behalf of and on account of the Company, they will handle the data only in accordance with the explicit instructions provided by the Company.

Personal data may also be accessed by internal and external auditors of the Company, with the assurance that they will be kept confidential and not used for purposes other than audits:

  • Payment processing companies (Stripe, Paypal)
  • Transport and delivery service providers (CTT, DHL)

Your personal data can only be transferred to countries outside the European Economic Area (EEA) that the European Commission deems to provide an adequate level of protection. If the third country (outside the EEA) does not offer this level of protection, your personal data can only be transferred to that country if the data exporter and data importer enter into applicable standard contractual clauses approved by the European Commission for the transfer.

What are my rights?

Right of access — you have the right to obtain confirmation of whether your data is being processed or not, and if so, to access your personal data and the information listed in this policy. If you require more than one copy of your personal data undergoing processing, the Company may subject this service to the payment of a fee for administrative costs.

Right of rectification — you have the right to obtain, without delay, the rectification of inaccurate or incomplete data.

Right to erasure ("right to be forgotten") — you have the right to obtain the erasure of your data, in certain cases, particularly if the data is no longer necessary for the purpose for which it was collected or processed; if you withdraw consent and there is no other legal ground for the processing of your personal data; and if you object to the processing, and there are no overriding legitimate grounds for the processing;

Right to restrict processing — you have the right restrict processing of your data in certain cases, particularly as a counterpart to unlawful processing and if you object to the erasure of your data; if the Company no longer needs the data for processing purposes, but you require them for the establishment, exercise, or defense of a legal claim in a judicial process; if you contest the accuracy of the data for a period allowing the Company to verify its accuracy; and if you object to the processing until it is verified that the Company's legitimate grounds prevail.

Right to data portability — if the processing depends on your consent and was provided by automated means, you have the right to receive your personal data in a structured, commonly used, and machine-readable format.

Right to object — you may object, at any time, to the processing of your personal data, especially when the processing is carried out (i) for the purposes of the legitimate interests pursued by the Company; (ii) for direct marketing purposes; or (iii) for profiling.

Your requests will be processed with special care to ensure the effectiveness of your rights. You may be asked to provide proof of your identity to ensure that the sharing of personal data is only done with the rightful owner.

You should be aware that in certain cases (for example, due to legal requirements), your request may not be immediately fulfilled. However, you will be informed of the measures taken in this regard within one month from the moment the request is made. Can I revoke my consent afterwards?

If consent is legally required for the processing of personal data, you have the right to withdraw consent at any time. However, this right does not affect the lawfulness of the processing carried out based on the prior consent nor the subsequent processing of the same data based on another legal basis, such as the execution of a contract or compliance with a legal obligation to which the Company is subject.
